Pedestrian Injuries in New Jersey
In many cases, when a pedestrian is hit by a vehicle, the driver is thought to be at least partially to blame. Pedestrians who are injured in car accidents are eligible to recover compensation for their losses and may bring a claim of personal injury against the at-fault driver.
Those behind the wheel owe a special duty of care to those on foot and are obligated to operate their vehicles as responsibly and as safely as possible. If a pedestrian is inside a crosswalk when an accident occurs, the driver is almost always held liable because pedestrians have the right of way.
Under New Jersey law, pedestrians have the right of way at crosswalks and intersections, and, as such, motorists are required to yield to them in these areas until the pedestrian has crossed the street. The law also states that, in the event of a pedestrian-involved accident inside a marked or unmarked crosswalk at an intersection, the permissive inference will be that the driver breached the duty of care they owed the pedestrian.
Most pedestrian accidents result in serious injuries. Personal injury protection coverage, with its many limitations, may not be enough to cover the medical costs associated with their injuries. Some pedestrian accident victims might not have a car insurance policy, or their insurer might dispute their injuries or their account of what happened.
