Wrongful Deaths in New York
If you have lost a family member in a New York pedestrian accident, the first thing you need to understand is when filing a wrongful death claim is applicable and who is entitled to do so.
Per New York law, a wrongful death suit is appropriate when the defendant’s negligence was the immediate cause of the victim’s death and, had death not resulted from the accident, the victim would have been able to file a personal injury claim against the defendant.
A wrongful death claim can be filed by a representative of the decedent’s estate. It seeks to prove the defendant’s negligence, along with causation, in order to collect compensation for the real and anticipated damages that the decedent’s survivors have and have yet to endure.
