Falling Tree Injuries in New York

There is a duty incumbent on property owners to inspect the trees on their premises and ensure that they are healthy, in good condition, and do not pose a threat to anyone on or near the premises.

Accidents caused by falling branches and trees center around the area of law known as premises liability. This legal concept includes accidents such as falls in stairwells with loose handrails, trips or slip-and-falls on uneven or wet floors, and falling boxes or merchandise in stores.

Every year, people throughout the United States are injured or killed by falling branches or trees. Most of these accidents are due to the negligence of the entity or individual responsible for the safety of visitors on their property. In these instances, victims may be eligible to pursue compensation for their damages.

Whether the premises where the accident took place is a private dwelling, a retail business, or even a public park or sidewalk, the owner or occupier of the property has a responsibility to maintain it in a reasonably safe condition.

If the owner or occupier of the property is aware of, or reasonably should be aware, of a tree in poor condition creating a potential hazard to visitors and fails to address the issue, then they could be held accountable for damages if someone is injured.
