Wrongful Deaths in New Jersey

Cedarhurst, NY - Motorcyclist Crashes on Beach 47th St, Hits Pedestrian, Leaves Passenger to Die

Proving wrongful death for the purposes of a personal injury claim must be demonstrated through the legal concept of negligence.

To prove liability for wrongful death, a surviving member of the victim’s family will need to show that three factors were present at the time of the fatal incident.

The first is a duty of care. When a person has a duty of care, it means they owed the victim a basic amount of consideration to ensure their safety and protect them from harm. For example, property owners have a responsibility to maintain their premises in a reasonably safe manner by making sure it is free of potential dangers such as wet floors and broken handrails.

The second factor is proving that the duty of care was violated. Taking into consideration the entire scenario and the knowledge the defendant had at the time, you will need to show that the respondent should have been aware that a person could be injured or killed as a result of their action or inaction.

The third factor that must be present is causation. This involves showing how the at-fault party’s violation of duty was the proximal cause of your family member’s death.
