Delran, NJ – Pedestrian Struck, Injured on Rt 130

Delran, NJ (August 02, 2022) – A pedestrian was hit by a driver in Burlington County on Tuesday, August 2nd. 

The incident occurred at about 5:00 a.m. in the northbound lanes of Route 130 in the area of Tenby Chase Drive in Delran. 

Emergency responders, including the Delran Police Department and Delran Fire Department, were dispatched to the scene.

The victim’s current condition is unknown. 

No information has been released on the driver of the striking vehicle.

New Jersey law grants pedestrians the right of way in both intersections and crosswalks, meaning drivers are obligated to yield until the pedestrian has crossed the roadway. The law also says that, in a collision involving a car and a pedestrian in a marked or unmarked crosswalk in an intersection, the permissive inference will be that the driver violated the duty of care they owed the pedestrian. 

Motorists owe a duty of care to others on or near the roadway, including pedestrians, and are expected to operate their vehicles responsibly, safely, and in accordance with the law. If a pedestrian is struck while in a crosswalk, the driver is almost certainly responsible because a pedestrian in a crosswalk has the right of way. 

Conversely, pedestrians are tasked with certain responsibilities that include crossing streets inside crosswalks at the proper time as well as looking both ways before they do so. Pedestrians who jump or run into the roadway, giving a driver no time to react, or pedestrians who stumble into the street while drunk or distracted, could be assigned a portion of liability for the accident. In New Jersey, even if a pedestrian does share in the liability for their accident, they are still entitled to collect comparative compensation.
