Wrongful Deaths in East Rutherford
The purpose of New Jersey’s Wrongful Death Act is to compensate survivors for the financial damages caused by the death. In the majority of cases, the most substantial recovery is for loss of financial support. This amount is based on the financial contributions which the deceased plausibly would have been presumed to make to the survivors. This portion of financial recovery is not need-based.
A jury may take into account the effects of inflation and, because the wages would have been spread out over the rest of the victim’s working life, any financial compensation must be discounted to match the current value of future predicted earnings.
