Financial Recovery for Pedestrian Accidents in New Jersey

Fair Lawn, NJ - Teen Charged Following Pedestrian Incident at Memorial Park

Every pedestrian injury claim is unique. The crux of your claim’s worth is the seriousness and permanence of your injuries. The value of your claim is comprised of your medical expenses and lost income, combined with intangible damages such as pain, suffering, and diminished quality of life.

Anytime a pedestrian is injured in a motor vehicle accident, their first method of seeking recovery is going to be the driver of the car that struck them. This means the victim will have to pursue compensation for their damages from their auto insurance company.

There are also cases in which they could be eligible to obtain recovery from a third party, such as the city or county where their accident took place if it resulted from hazardous road conditions or a poorly designed roadway. Pedestrian victims could also be qualified to collect remuneration from the insurer of the property manager or owner if a dangerous situation or condition in their parking lot or on their sidewalk played a role in their accident.

Common forms of financial compensation that injured pedestrians are generally entitled to collect include:

  • Doctor, hospital, and other medical bills
  • Physiotherapy costs
  • Ambulance and paramedic bills
  • Prescription medication costs
  • Transportation to and from medically necessary appointments
  • Lost income from being unable to work
  • Pain and suffering
  • Punitive damages

Under New Jersey’s Comparative Negligence Act, a victim is entitled to compensation for their injuries, even if they were partially responsible for the incident that caused them.

Insurance companies assign every individual involved in the accident a portion of fault. The damages a victim is ultimately awarded will be reduced by their percentage of fault. For instance, if a pedestrian’s intoxication contributed to an accident in which they were hit by a car, the insurer could find them to be 30% at fault for the accident. Their $100,000 claim would then be decreased to $70,000.
