Wrongful Deaths in New Jersey
If you have lost a family member in a New Jersey accident, the first thing you need to understand is when filing a wrongful death claim is appropriate and who is entitled to do so.
Per the state’s wrongful death laws, a wrongful death suit is applicable when the defendant’s negligence was the immediate cause of the victim’s death and, had death not been the result of the accident, the victim would have been entitled to file a personal injury claim against the defendant.
A wrongful death claim may be filed by a representative of the decedent’s estate. It seeks to prove the defendant’s negligence, along with causation, in order to collect financial compensation for the real and anticipated damages that the decedent’s survivors have and have yet to endure.
