Who Can File a Wrongful Death Claim in Burlington Township, NJ?Hit-and-Run Leaves Man Dead on Sunset Rd

In New Jersey, a wrongful death claim is brought by the personal representative of the deceased person's estate, such as an executor or administrator, for the benefit of surviving family members.

Those who may benefit usually include a spouse, children, or other heirs under state intestacy rules. The claim generally must be filed within two years of the date of death, though limited exceptions can apply.

A wrongful death claim is commonly paired with a survival action, and the two cover different losses. Firstly, a wrongful death focuses on what the family lost, such as financial support, household services, guidance, companionship, and funeral expenses.

Secondly, a survival action allows the estate to pursue damages the person could have claimed had they lived, which may include pain and suffering before death and lost earnings. Which losses apply depends on the facts, so cautious evaluation matters.

To determine how the wreck happened, investigators rely on business surveillance video, vehicle damage, and witness memories, which may be lost or altered within weeks. A wrongful death lawyer can help a family identify who may serve as the estate's representative, preserve that evidence, and sort out which losses may be claimed before the two-year deadline arrives.
