New Jersey is a no-fault state, so a driver's own auto policy generally pays medical bills first through personal injury protection, or PIP, regardless of who caused a wreck.
When drivers purchase a policy, they can select PIP limits that range from $15,000 up to $250,000. The amount chosen can affect how far that medical coverage stretches. PIP may also cover certain expenses related to medical treatment and other qualifying losses, depending on the policy and applicable rules.
A second choice can shape a claim even more. New Jersey drivers pick either the unlimited right to sue option or the limitation on lawsuit option, typically called the verbal threshold.
Under the limitation option, a person who seeks compensation for pain and suffering from another driver generally must show a qualifying injury, such as a permanent one, and that usually requires a physician's certification. The limitation option generally applies when no selection was made.
The choice between these options can affect whether an injured person may pursue noneconomic damages after a motor vehicle crash. Policy language, injury circumstances, and the applicable statutory requirements can all matter when determining what claims may be available. Reviewing the insurance policy and medical documentation can help clarify which PIP benefits and lawsuit restrictions apply.
After a car accident, insurers usually review medical records and bills closely, so a car accident lawyer can help read a policy, explain how the lawsuit option may apply, and gather the documents an insurer may request.
