Pedestrian Injuries in New Jersey
Pedestrians injured in a car accident are entitled to recover financial compensation for their damages and can file a claim of personal injury against the at-fault driver. This is because motorists owe a certain duty of care to walkers and are required to drive their vehicles safely and responsibly. Especially if the pedestrian was inside a crosswalk, the vehicle’s operator is nearly always considered to be liable since pedestrians have the right of way.
Most pedestrian accidents result in serious injuries. Personal injury protection coverage, with its many limitations, may not be enough to cover the medical costs associated with their injuries. Some pedestrian accident victims might not have a car insurance policy, or their insurer might dispute their injuries or their account of what happened.
New Jersey law says that pedestrians have the right of way at intersections and crosswalks. As such, drivers are expected to yield to pedestrians at these locations and remain there until the pedestrian has crossed the street. So, in the event of an accident involving a pedestrian and a vehicle inside a marked crosswalk, or inside an unmarked crosswalk in an intersection, the belief will be that the driver violated their duty of care for the pedestrian’s safety.
