Pedestrian Injuries in New Jersey
Anytime a pedestrian is injured in a collision with a motor vehicle, the first avenue of economic recovery they should pursue will be via the driver of the vehicle that struck them. This means the injured victim will need to seek payment for their damages from their auto insurance company.
New Jersey’s Comparative Negligence Act says that a victim is entitled to compensation for their losses, even if they are found to share in the liability for the event that caused them.
An insurance company will assign each individual involved in the incident a percentage of liability. The total amount of losses that the injured pedestrian is ultimately awarded will be reduced by that same percentage.
Standard forms of financial compensation that injured pedestrians are usually awarded include:
- Medical, doctor, hospital, and other healthcare provider bills
- Costs of physical rehabilitation
- Ambulance and paramedic costs
- Prescription drug costs
- Transportation to and from medically necessary appointments
- Lost income due to being unable to work
- Exemplary damages
- Pain and suffering
