New York Pedestrian Collisions
Pedestrian collisions happen all too often in the state of New York. Every year, approximately 300 pedestrians lose their lives in motor vehicle collisions and over 15,000 sustain injuries. In New York City alone, over 100 pedestrians lose their lives each year. Additionally, about 9% of all traffic accidents reported throughout the Empire State involve a pedestrian who either sustains injuries or loses their life.
Oftentimes, when pedestrians are struck by vehicles, drivers are often believed to be to blame, either partially or wholly. Pedestrians who suffer injuries in traffic accidents caused by negligent drivers are usually eligible to collect financial compensation that can help them pay for some or all of the damages that result from their accidents. Working with a pedestrian crash lawyer in the aftermath of your accident could help you recover in more ways than one, and get you on the fastest track to financial recovery.
Drivers owe a duty of care to pedestrians and are expected to operate their vehicles in a safe and responsible manner. When a pedestrian is struck while walking in a crosswalk, for instance, the driver is almost always found to be at fault due to the pedestrian having the right of way.
The law in the state of New York shows that pedestrians have the right of way at intersections and crosswalks. Therefore, drivers must legally yield the right of way to all pedestrians at all times and remain at a complete stop until the pedestrian has exited the roadway.
