Passenger Deaths in New Jersey
In order to claim damages, the respondent named in a wrongful death suit must have violated the duty of care they were obligated to show the victim. The standard of negligence in a wrongful death suit is the behavior that a prudent person would have exhibited in the same or similar circumstances. If a reasonable person would have conducted themselves more carefully or exerted more caution, the respondent will most likely be held liable.
For example, if a driver acted carelessly by violating a driving law, then they have failed in upholding the duty of care they owed to the victim.
