Help with Your Motorcycle Accident
If you have been hurt in a motorcycle accident, it is important to enlist the help of an attorney with experience in these types of cases. Motorcycle accidents can be more complicated than other types of car accidents. The fact that motorcyclists lack protection while out on the road means they are more likely to sustain catastrophic injuries that demand extensive medical treatment.
When it comes to injuries for motorcyclists, statistics show that one out of every five motorcycle crashes results in head or neck injuries for riders. This can lead to huge, ongoing medical bills for which you will need compensation.
New York and New Jersey have reported some of the highest incidents of motorcycle fatality rates in the country. These accidents can be caused by a variety of factors, including:
- Driver negligence
- Drunk driving
- Aggressive driving
- Poor road conditions
- Traffic congestion
- Motorcycle defects
Inattentive automobile drivers present a great danger to motorcyclists. The fact is that 80 percent of these accidents are clearly shown to be the fault of the automobile driver and not that of the motorcyclist. Motorcyclists face a far higher risk of involvement in an injury-causing crash, highlighting the need for a knowledgeable lawyer.
Motorcycle Accidents Caused by Defects
A defective product could easily ruin the freedom and excitement you feel riding your motorcycle. Not all motorcycles are created equal, as some are poorly designed and potentially hazardous. It is your right as a consumer to have a safe, efficient product. If you’ve been injured in a motorcycle accident caused by a motorcycle defect, we have the experience with product injuries to properly represent you and hold the correct party responsible.
Help with Your Aviation Accident
Injuries from airplane accidents are almost always serious. If you or a loved one has been injured in an aviation accident, a personal injury lawyer experienced in litigating both serious injuries and airplane accidents can help you obtain the financial compensation you deserve.
From our offices in Newark and in New York, the personal injury law firm of Metro Law has won substantial awards for victims of plane crashes. In one case, a commercial jet crashed due to a lack of fuel. Our attorneys argued that better handling of the situation in the air and on the ground could have prevented the accident. Seventy-three people were killed and 85 were injured, including our client and our client’s son. We sued the airline for over $200 million to compensate our client and our client’s family for pain and suffering, loss of income, and punitive damages.
Each Case is Unique and Results Will Vary Depending on the Facts of Each Case
Aircraft accidents can result from a failure of the plane, failure to properly maintain the plane, and failure to properly respond to a problem or crisis. If you were injured or a loved one was injured or killed in an airplane crash, we can work to determine whether the airline, manufacturer, airport, maintenance company, or contract pilot was negligent and sue for damages.
In aviation accidents, the federal government is usually the lead investigator. We can work with federal agencies and investigators, as well as medical care providers, to gather facts and build your case. Also, airplane crashes usually involve multiple levels of errors. We are experienced in investigating and litigating aviation accidents. We can solve the complex issues of multiple liability and insurance and pursue the award you deserve.
Help After a Boating Accident
When fun in the sun on the family boat turns from good to bad because of the carelessness of other New York and New Jersey boaters, you need somewhere to turn to get your questions answered. Fortunately, you can trust the boating accident lawyers of Metro Law. With decades of successful personal injury litigation from our Newark, New Jersey, and New York offices, our attorneys know the ins and outs of handling boating accident claims and are dedicated to serving every client with compassion, respect, and understanding. Let us help you through this difficult time.
Boat Injury Basics
Whether your boating accident was caused by another boat operator’s drunkenness or inexperience, you likely have a valid claim, particularly if the accident injured you or someone on your watercraft. Among the most common causes of boat accidents are:
- Careless or reckless operation
- Operator inattention
- Operator inexperience
- Excessive speed
- Hazardous waters
- Alcohol use
Additionally, the three most common types of New York and New Jersey boat accidents are collisions with other vessels, collisions with fixed objects such as a pier, and passengers falling overboard. Other common types of accidents are skier mishaps and capsizing.
Boating Accidents: What You Should Know
- As with a vehicle accident, it’s helpful to keep documentation relating to your boating accident in a convenient location. Items that may be helpful to your claim include the boating accident report, receipts from boat repair work and medical care, and photographs of the damage to your boat, the accident scene, and the injuries you and any other passengers suffered.
- Also, if you haven’t already done so, try to get the names and contact information of anyone who may have witnessed the accident. Contacting these people as your claim develops may be helpful, as witnesses can attest to the carelessness of the other boater.
- Another note of importance is to be careful speaking to insurance adjusters. Often, an adjuster with the other boater’s insurance provider will contact the other party to get a statement or have him or her sign a release.
- If someone contacts you for something similar, know that you don’t have to talk to the adjuster nor do you have to sign a release. In fact, it’s best to contact an attorney before doing either to be sure that you don’t sign away any rights or hurt your claim.

Federal Employers Liability Act
Under FELA, if the injury to the employee was not caused by the employer’s negligence, then there can be no recovery for pain and suffering. However, the employer is still responsible for paying the employee’s medical bills and a percentage of his or her lost wages. This is called maintenance and cure.
One unfortunate aspect of FELA is that if the injured worker reaches maximum cure, the employer doesn’t need to pay for his or her medical bills. In other words, if medical bills are purely for palliative treatment (that is, to treat pain) rather than providing functional improvement, the employer can cut off benefits. If the employer was negligent, you are entitled to compensation for pain, suffering, disfigurement, future pain and suffering, lost wages, and all medical bills.
For example, if there is no cure for an employee’s back pain and the patient is functionally as good as he or she will get, then paying for prescriptions to alleviate pain will be the responsibility of the employee, not the employer. It’s unfair, but it’s the law. The only way to force an employer to pay for palliative treatment is if we can prove the employer was negligent or did not provide a safe place to work. If there is a dispute regarding whether treatment is palliative, the court will generally rely on the word of your treating physician.
To sum it up, if the employer was negligent, you are entitled to compensation for pain, suffering, disfigurement, future pain and suffering, lost wages, and all medical bills. If the employer was NOT negligent, then you are entitled to maintenance and cure that is payment of medical bills and a percentage of your lost wages until you have reached a state of maximum medical improvement.
The Duty of School Bus Drivers
The New York and New Jersey school bus accident attorneys of Metro Law will thoroughly investigate the factors contributing to a school bus accident to better understand who should be held liable. You may be able to file a claim against the bus company to recover for your damages. If you were a passenger on a bus that was involved in an accident, the bus company, whether public or private, owes you the “utmost duty of care” associated with being a common carrier. This “duty of utmost care” is higher than the negligence duty owed by the bus company to drivers of other vehicles and pedestrians.
Because we entrust them with our children’s safety and lives, school bus drivers must abide by all transportation laws, including laws that prohibit speeding and consuming alcohol before or while driving. In addition, companies that maintain public transportation vehicles like buses are liable for the safety of their vehicles. If you or your child has been injured in a school bus accident, we can help.
How Serious are Bus Accidents?
School bus accidents are the most tragic of all motor vehicle accidents due to the inherent involvement of young children. As a result, substantial damages are often at issue in cases of this type, and vigorous representation is required to bring all responsible parties to justice.
School bus accidents can be caused by such contributing factors as driver negligence, dangerous roads, weather conditions, defective products, and improper maintenance, among others. These accidents may lead to death or serious physical injury, including:
- Head injuries
- Burn injuries
- Brain and spinal cord injuries
- Fractured bones
- Cuts and bruising
- Internal injuries
A school bus accident can impact the lives of victims and their families. Depending on the severity of the accident, victims may need to undergo surgery or visit numerous specialists. Treatment for school bus-related injuries may be expensive and cause financial stress on the family. If you retain a skilled bus accident injury lawyer, you may be able to recover monetary compensation for your injuries and other accident-related costs.
We Defend Pedestrians’ Rights
If you have been struck by a car, truck, or another vehicle, you have rights as a pedestrian. Whether it was a hit-and-run accident or the driver stayed to give you insurance information, it is up to you to take action and make sure you get the medical help you need and the financial compensation you deserve.

Does Your Insurance Cover You?
New York City is a dangerous place for pedestrians, and most pedestrian accidents occur on city streets. It is important to understand that jaywalking is not a bar to making a personal injury claim. Drivers are responsible for staying aware of what is in the path of their car.
Many pedestrians in New York and New Jersey do not drive so they are unfamiliar with the rules of the road for drivers and the laws regarding insurance. If you have been injured in a pedestrian accident, your medical bills will be covered by no-fault insurance in both New York and New Jersey.
No-fault insurance will cover everything from medical bills to lost wages. If you have lost a loved one in a pedestrian accident, insurance will cover funeral costs as well.
A pedestrian has little protection when struck by a car. Although it depends on the nature and circumstance of the accident itself, pedestrian accidents often lead to catastrophic injuries, including spinal cord damage and paralysis. We are here to protect you and make sure you get the medical care you need.
