Who Is Liable in a Left-Turn Motorcycle Crash in South Plainfield, NJ?

Motorcyclist Killed in Crash on Ledden Ter

In New Jersey, a driver who makes a left turn is generally required to yield to oncoming traffic, including motorcycles, before proceeding. When a left-turning vehicle crosses into the path of an oncoming motorcyclist, the turning driver can bear a significant share of fault.

Motorcyclists involved in left-turn collisions can face serious injuries because they have little protection compared to occupants of passenger vehicles. Common outcomes include fractures, head trauma, and injuries that require extended recovery time or rehabilitation.

Under New Jersey's Wrongful Death Act, a deceased motorcyclist's spouse, children, or other close family members may be entitled to bring a claim through the appointed representative of the person's estate.

This legal process is separate from any criminal investigation and focuses on the financial and personal losses experienced by surviving family members, such as lost income, funeral costs, and the loss of companionship.

A wrongful death lawyer can help grieving families by gathering evidence related to how the accident occurred, including witness statements and traffic camera footage if available. They can also communicate with insurance companies on the family's behalf and explain what types of compensation may be available under New Jersey law, depending on the specific facts of the case.
