New Jersey Pedestrian Accidents

Mount Laurel, NJ - Donte Horton, 28, Killed in Fatal Pedestrian Crash on Atlantic City Expy near milepost 22.8Most of the time, pedestrian collisions cause injuries that are serious or even catastrophic. This is obviously due to the fact that pedestrians are much smaller than cars, and travel totally unprotected. In the event of a collision, they almost always get seriously hurt or lose their lives. Most pedestrian accidents result in serious injuries. Unfortunately, personal injury protection coverage has various restrictions, which may render it unable to cover all of the medical care costs related to a serious pedestrian crash injury. Pedestrians may not possess car insurance, or their provider may dispute their version of the accident, or even the severity of their injuries.

With the help of a pedestrian crash lawyer, an injured pedestrian can get the financial compensation they need and deserve after being injured in a serious accident. A lawyer can help them deal with the insurance company so they’re able to successfully recover.

In New Jersey, the law says that pedestrians have the right of way at intersections and crosswalks. This indicates that motorists are required to yield to them until they are out of the road. In the event of a crash between a motorist and a pedestrian, the law also states that the driver most likely violated their duty of care to the pedestrian, regardless of whether the incident occurred inside or outside of a crosswalk.

On the contrary, pedestrians also owe drivers certain duties of care, such as crossing at specified crosswalks and making sure vehicles aren’t coming while they do so.

In rare circumstances, pedestrians may share in the liability for the collision. Pedestrians who walk out in front of vehicles without warning due to being intoxicated or distracted are an example. However, even if a pedestrian is partially at fault for the accident, they still have the option to collect financial compensation for their injuries.
