Pedestrian Accidents in New Jersey
Determining if a motorist involved in a pedestrian accident acted negligently depends on numerous factors. They may have been walking, standing, or jogging in an area designated for them to do so when they were injured, but that fact alone is not enough to prove a driver acted negligently and, therefore, is liable for the resulting injuries.
A pedestrian may have been inside or outside of a crosswalk when the accident happened, but, again, this fact alone will not prove if and to what degree the driver was negligent. Where pedestrian accidents are concerned, the determination of negligence demands careful study, critique, and presentation of all factors that played a role in the incident.
A New Jersey pedestrian accident lawyer must then explain the facts to a jury, showing that the driver of the car failed to exercise reasonable care.
Pedestrian accident attorneys must have experience and legal proficiency if they hope to be awarded the maximum recovery or favorable verdict on their client’s behalf.
