Wrongful Death and Survival Claims After a Fatal Fire in Jersey City, NJ

One Dead, 3 Hurt in 4-Alarm Fire on Boyd Ave

After a fatal fire, New Jersey generally gives a family two years from the date of death to file a wrongful death lawsuit under the state's Wrongful Death Act.

A personal representative of the estate usually brings the claim on behalf of eligible family members. Recoverable losses can include lost financial support, household services, guidance, advice, and companionship, along with reasonable funeral costs.

A separate law, the Survival Act, allows the estate to pursue claims the person could have brought had they lived. That can include pain and suffering between the injury and the death.

}The two claims have different purposes and different beneficiaries, so they are usually considered together. People who were hurt and lived generally have their own personal injury claims, which in New Jersey usually carry a two-year deadline.

Who may be legally responsible depends on facts that can take time to establish. In a dense city like Jersey City, with corridors lined with multi-unit buildings, ownership and maintenance duties can involve several parties. Inspection reports, maintenance logs, smoke alarm records, leases, and insurance policies may all matter.

If a public entity owned or managed the property, a much shorter 90-day notice requirement under the New Jersey Tort Claims Act can apply. A wrongful death lawyer can help a family open the estate, request those records, and work with fire cause specialists to evaluate who may bear responsibility.

Deadlines, estate paperwork, and the difference between wrongful death and survival claims can be hard to sort out during a loss. At Metro Law, we can help families understand how New Jersey law generally treats each type of claim.
