What Are a Driver's Legal Duties After Striking a Pedestrian in Old Bridge, NJ?

One Dead, One Hurt in Crash on Rte 34

New Jersey law requires a driver involved in a crash resulting in injury or death to stop immediately, remain at the scene, and provide aid or arrange for medical help if someone is hurt.

Stopping at the scene satisfies a driver's basic legal obligations, but it does not by itself determine who was at fault for what happened.

Fault in a pedestrian collision usually depends on factors such as whether the pedestrian was in a marked or unmarked crosswalk, whether traffic signals were functioning, and whether the driver had a clear line of sight.

New Jersey follows a modified comparative negligence rule, in which an injured pedestrian, or a deceased pedestrian's estate, can still recover damages as long as the pedestrian is not found more than 50 percent responsible for what happened.

Evidence such as witness statements, traffic camera footage, and the police report can play a significant role in establishing exactly how the accident unfolded. A pedestrian accident attorney can help gather this evidence and determine how fault may be divided between the parties involved.

At Metro Law, we can help sort out what options apply to each situation and walk families through the process step by step.
