Most personal injury claims in New Jersey must be filed in court within two years of the date of injury.
Wrongful death claims generally follow a similar two-year period, measured from the date of death. If a claim involves a minor or any public entity, there may be exceptions to the timeline that can extend or shorten the timeline.
When a child is hurt, timing can work differently since New Jersey law may pause the clock until the child turns 18. The clock can also start later in some cases, such as when an injury was not reasonably discoverable right away. Whether an exception applies depends on the facts, so it is worth confirming early rather than assuming.
Claims that involve a public entity, such as a roadway maintained by a government body, can carry a much shorter deadline. Under the New Jersey Tort Claims Act, a written notice of claim generally must be filed within 90 days.
To make sure that any deadline isn’t missed, a pedestrian accident attorney can help sort out which timeline applies to each particular claim and whether a notice is needed before time runs out.
