New Jersey law requires drivers to exercise particular caution around pedestrians, granting them the right of way in marked and unmarked crosswalks and requiring drivers to stop, not simply slow down, when a pedestrian is crossing within a crosswalk.
This standard reflects the significant vulnerability pedestrians face in any collision with a vehicle, since even a crash at relatively low speed can result in serious injuries, given that a person's body absorbs the full force of impact without any protective structure around them.
New Jersey allows an injured person to pursue compensation for the long-term medical costs that the injuries cause, along with lost wages during recovery. However, the state's no-fault insurance framework means that a person's own Personal Injury Protection coverage typically pays initial medical bills regardless of fault, before any claim against the driver comes into play.
To pursue additional compensation beyond PIP benefits, an injured pedestrian generally needs to meet New Jersey's verbal threshold, which requires demonstrating that the injury caused a permanent or significant impairment.
To establish this medical records that document the injury's severity and its effect on daily life are typically required. Here, a pedestrian accident attorney can get involved to coordinate with treating physicians to build a complete picture of the injury's long-term impact before an insurer has a chance to characterize it as minor.
At Metro Law, we work with pedestrians navigating New Jersey's PIP and verbal threshold requirements following serious injury crashes.
