New Jersey's Wrongful Death Process for Families in Hamilton, NJPickup Truck Collides With Motorcycle, Killing Rider

Under New Jersey's Wrongful Death Act, a claim can be filed by the personal representative of the deceased's estate on behalf of surviving family members, including a spouse, children, or other dependents.

New Jersey law allows recovery for the pecuniary, or financial, losses these survivors experience because of the death, such as lost income and financial support the deceased would have provided.

Non-economic losses like grief are not directly recoverable under the wrongful death statute itself, though a separate survival action can address the pain and suffering the deceased experienced before death.

New Jersey requires wrongful death claims to be filed within two years of the date of death, a deadline that can affect a family's ability to pursue compensation once it passes.

A related survival action, which continues claims the deceased could have brought had they lived, is generally subject to the same two-year period. These deadlines can run alongside other legal proceedings, which is why many families turn to a wrongful death lawyer to help them gather relevant records early, including medical and employment documentation that may support a claim.

Our team at Metro Law works with families across New Jersey who are navigating a wrongful death claim after losing a loved one on the road. If your family is dealing with a similar situation, we are here to help you sort through your options.
