In order to be viable, the defendant named in a wrongful death claim has to have breached the duty of care they owed to the deceased. The benchmark for negligence in a wrongful death case is the action that a reasonable person would have taken under the same or similar conditions. If they would have exercised more caution or conducted themselves more carefully, the defendant will be held responsible.

For instance, if a driver behaved recklessly by breaking a law, then they have breached the responsibility they owed to the deceased.
