New York Car Accidents
In a personal injury claim, establishing wrongful death is different from a criminal case. In a criminal case, prosecutors must prove the guilt of a defendant beyond a reasonable doubt. Wrongful death claims are civil cases that are proven through the legal theory of negligence.
In order to establish liability in a wrongful death claim, a case must possess certain elements, which are:
- A duty of care owed to you or your family member that was breached by a negligent party. The negligent party acted in a manner that failed to consider your or your loved one’s safety and, as a result, put you in harm’s way.
There are many different forms of negligence that drivers display on the roadways today. The most common form of driver negligence seen on the roadways in New York and throughout the United States is driver distraction. Smartphones have become extremely popular in society. Due to this, people feel like it is okay to check them at any time, even while behind the wheel of a moving vehicle. This is never safe, and should always be avoided.
If you or someone you love has been injured by the actions of a negligent driver, whether they were distracted, intoxicated, over-tired, or speeding, you may be eligible to collect financial compensation for the losses and damages you face in relation to your accident.
Even worse, you may have lost someone you love due to the actions of a negligent driver. This is possibly the worst thing that can happen and can make your world seem like it has come to a complete halt. You may be wondering how you will recover, and money may be the furthest thing from your mind at a time like this.
However, unfortunately, losing someone to a severe auto crash does end up costing money in one way or another. The cost of funeral care can range in the tens of thousands, and, when paired with medical bills, can be an extreme expense for any family. If you know your loved one’s crash was caused by driver negligence, it is important to speak with a wrongful death lawyer in New York as soon as you can.
