September 23, 2026

West Seneca, NY (September 23, 2026) – A pickup truck driver died Tuesday, September 22, after the truck hit another vehicle on Harlem Road in West Seneca.

West Seneca Police said the crash happened around 7:15 p.m. Officers had tried to stop the pickup truck when the driver allegedly fled at a high speed. The truck traveled about a half-mile before it struck a vehicle traveling north. The pickup rolled onto its roof and caught fire, and emergency units quickly put out the flames.

Three people in the other vehicle were hurt to varying degrees and taken to the hospital.

We extend our condolences to the driver's loved ones and our thoughts to the three people recovering.

What Rights Do People Have After a Police Pursuit Injury in West Seneca, NY?Police Pursuit Ends in Fatal Crash on Harlem Rd

New York law gives people harmed in a pursuit-related accident several possible paths. These include a claim against the fleeing driver, benefits under their own no-fault and uninsured motorist coverage. In some limited cases, it is possible to file a claim against a municipality if the pursuit involved reckless disregard for public safety.

The fleeing driver is typically the most direct target of a claim, since ordinary negligence rules apply to that driver's conduct. Most New York personal injury lawsuits must be filed within three years, while wrongful death claims generally carry a two-year deadline.

Medical costs and lost earnings may first be covered through no-fault benefits. In cases where the driver who fled has little or no insurance, uninsured motorist coverage on a person's own policy can come into play.

Claims against a municipality follow different rules. New York law lets emergency vehicle drivers exceed speed limits during an emergency operation, but it does not shield them from the consequences of reckless disregard for the safety of others. That standard is harder to meet than ordinary negligence.

A written notice of claim generally must be served within 90 days when a municipality may be responsible, and a car accident lawyer can help gather pursuit records, identify the correct entity and prepare that notice.
