Pedestrian Damages in New Jersey

Queens, NY - Accident on Roosevelt Ave Leaves Man in Critical Condition; Driver Flees Scene

Every pedestrian injury case is distinct and the weight of the claim lies in the severity and longevity of the pedestrian’s injuries. Standard forms of financial compensation that injured pedestrians are usually awarded include:

  • Medical expenses
  • Physical therapy costs
  • Ambulance and paramedic fees
  • Prescription medication expenses
  • Rides to and from related appointments
  • Lost wages from being unable to work
  • Exemplary damages
  • Pain/Suffering

An insurance company will assign each individual involved in the incident a percentage of liability. The total amount of losses that the injured pedestrian is ultimately awarded will be reduced by that same percentage.

In some cases, victims might be entitled to file a suit for recovery against a third party, like the municipality where the accident occurred in the event that hazardous road conditions or a badly designed intersection played a role. Pedestrian victims might also be qualified to collect compensation from the insurer of the property manager or owner if a treacherous circumstance or condition on their footpath or in their parking lot had a hand in the incident.
