New Jersey drivers choose between two lawsuit options when they buy auto insurance. The limitation on lawsuit option, which is the default, restricts pain-and-suffering claims to certain categories of injury, such as a permanent injury, displaced fracture, or significant scarring. The no-limitation option keeps the ability to sue for any injury, usually at a higher premium.
Choosing an option usually happens quickly at renewal, and many drivers could not say which one is on their policy. The option tied to a person's own policy usually decides which rules apply to a pain-and-suffering claim, so it is worth checking before a claim moves forward.
Under the limitation option, a person generally has to show an injury that fits a category in state law, and permanent injury is the most common. That means a body part that has not healed to function normally and, within a reasonable degree of medical probability, will not heal with further treatment.
A physician's certification of permanency is generally due within 60 days after the defendant files an answer, so treatment records and follow-up visits matter.
A car accident lawyer can help confirm which option applies to a policy, coordinate with treating providers on documentation, and explain how the standard may shape settlement discussions.
Your policy's lawsuit option can shape what a claim looks like, and many drivers are unsure which one they chose. At Metro Law, we can go over your declarations page and explain how the limitation on lawsuit options may apply to you.
