Lawsuits Against the Deceased in New Jersey
New Jersey law states that if you are injured by another person, you are permitted to file a personal injury claim even if the at-fault party died.
The decedent’s estate will have an executor or personal representative. One of the executor’s duties is to contest your claim for medical costs, lost wages, pain and suffering, and other damages arising from the accident.
The estate of the deceased must get through probate before you will be able to act on your personal injury claim. Probate is the process by which an estate is divided into inheritances and bequests, and debts are paid.
Filing a claim will make you a potential creditor, and if it is settled or is won at trial, the estate will be required to pay you your award or settlement the same as any other debt.
If you were injured by a negligent driver who died in the accident or shortly thereafter, we encourage you to speak with a New Jersey personal injury lawyer who can walk you through the process of filing a claim against an estate after it has been through probate.
Although an estate, just like an individual, can be sued, there are numerous legal formalities that must be followed. A reliable car accident lawyer is in the best position to give you dependable advice that will help you secure the compensation you deserve.
