Wrongful Death in Rochester
A wrongful death applies to any situation in which another person’s actions or their failure to act, as the case may be, is the cause of the death of someone else. Differing from manslaughter or murder charges, lawsuits involving wrongful death are handled in civil court, as opposed to a criminal court. They carry punishments of hefty financial compensation, not incarceration.
The law provides for the family of the victim or the victim’s estate to file and receive financial compensation for damages on the victim’s behalf. Loss of income and benefits, loss of companionship, hospital bills, funeral and burial costs, emotional trauma, pain and suffering, and other punitive damages are able to be factored in when the total damages are being assessed.
