Newstead, NY (September 4, 2026) – One person died on Friday morning, September 4, after a tractor-trailer struck a disabled pickup truck parked on the shoulder of the Thruway in the town of Newstead.
Troopers said the 2018 Volvo semi was headed westbound on I-90 when it struck the parked 2012 Chevy pickup. The driver of the pickup, whose identity has not been released, died at the scene.
A passenger in the truck was taken to Erie County Medical Center with non-life-threatening injuries. The semi-truck did not report injuries and passed a field sobriety test administered by troopers.
New York State police say the wreck is still under investigation.
Our condolences go out to the family of the man who died.

Fatal crashes that involve tractor-trailers can raise different legal questions than typical passenger vehicle crashes.
Federal trucking regulations set specific requirements for rest breaks, vehicle maintenance, and how a commercial driver must respond to hazards like a disabled vehicle on the shoulder, and any violation of those standards can factor heavily into a liability case.
Families who lose a loved one in this kind of crash tend to face immediate funeral and burial costs on top of long-term financial strain, especially when the person who died was a primary source of household income. Meanwhile, surviving passengers may face ongoing medical treatment and rehabilitation long after the initial hospital visit.
Under New York law, a wrongful death claim is distinct from a survival action, and a wrongful death lawyer can help a family determine which applies and how to pursue both if appropriate.
A wrongful death claim seeks compensation for the financial losses experienced by a spouse, children, or other next of kin and generally must be filed within two years of the death.
By contrast, a survival action is brought on behalf of the deceased's estate for what the person themselves endured between the crash and the time of death, including any pain endured and medical costs incurred. This claim follows the standard three-year filing window used in personal injury cases.
