Wrongful Deaths in New Jersey
The standard of negligence in a wrongful death claim is the action that a reasonable person would have taken under the same or similar circumstances. If a sensible person would have acted with more care or exercised more cautiousness, the respondent will most likely be held responsible.
In order to claim damages, the respondent named in a wrongful death claim must have breached the duty of care they were expected to show the deceased.
For instance, if a driver behaved carelessly by breaching a driving law, then they have failed to uphold the duty they owed to the deceased.
The New Jersey wrongful death lawyers from Metro Law have assisted the bereaved families of several hundred wrongful death victims. We realize the extent of the trauma that comes with losing a family member from the negligent actions of another person. Wrongful deaths are a singularly distressing experience and one for which the law has a legal remedy.
