How Does New Jersey's No-Fault Insurance Apply After a Parkway Crash in Tinton Falls, NJ?

New Jersey is a no-fault state, which means drivers generally turn to their own Personal Injury Protection, or PIP, coverage to pay initial medical bills after a wreck, regardless of who caused it.

This applies whether a person was a driver or a passenger, and it applies even in multi-vehicle situations. The main goal of PIP coverage is to get medical treatment started quickly without waiting on a fault determination.

New Jersey drivers typically choose between two insurance options when they buy a policy: a basic policy or one with the right to sue for pain and suffering, often called the "limitation on lawsuit" threshold.

Under the threshold option, an injured person generally must show a permanent injury or meet another specific legal standard before they pursue a claim beyond PIP benefits.

New Jersey also allows injured people to pursue compensation from an at-fault driver once PIP limits are reached or the legal threshold is met. To determine fault, New Jersey follows a modified comparative negligence rule. Under this system, a person is allowed to recover damages as long as they are less than 50 percent responsible.

In these types of cases, a car accident lawyer can help review a policy's coverage type and determine whether an injury meets the threshold required to pursue further compensation.
