Why Truck Crashes Raise Serious Legal Questions in Newark, NJ

Tractor-Trailers Collide on NJ Trnpk, Trapping Driver

Commercial trucking companies and drivers are held to a higher standard under both federal and New Jersey law. Federal Motor Carrier Safety Administration rules govern how many hours a driver can be on the road, how vehicles must be inspected, and how cargo must be secured. When those rules are ignored, the resulting evidence can become central to any personal injury claim.

Large truck cases that involve multiple vehicles commonly name more than one liable party. The trucking company, the driver, and sometimes a maintenance or cargo contractor can each carry a share of responsibility depending on the circumstances that caused the vehicles to strike one another.

Under a legal principle known as respondeat superior, an employer can be held responsible for a driver's actions while on the job, which usually broadens who can be pursued for damages.

Cases that involve federal safety regulations can hinge on records that are only obtainable early, such as electronic logging device data or inspection reports, some of which carriers are only required to retain for a limited time.

A truck accident lawyer in Newark can help request and preserve this kind of documentation before it disappears, which can make a meaningful difference in how liability is ultimately determined. That documentation typically becomes the foundation for negotiating with a trucking company's insurer.

Truck cases can be more complex than standard passenger vehicle claims because of the number of parties and regulations involved. At Metro Law, we can help you identify who may be responsible for your accident and what next steps you could take.
