After a car accident in Hanover Township, medical bills usually start to arrive long before anyone decides who was at fault. New Jersey is a no-fault state, so a driver's own personal injury protection coverage, known as PIP, generally pays for treatment costs no matter who caused an accident. PIP limits vary by policy, and drivers choose from several coverage levels when they buy insurance.
The lawsuit option selected on a policy can shape what a person may pursue beyond PIP. Most New Jersey policies carry either a limitation on lawsuit option, usually called the verbal threshold, or a no limitation option that usually comes with a higher premium.
Under the limitation option, a person generally can seek compensation for pain and suffering only when the harm falls into categories the law lists, such as a displaced fracture, significant scarring, or a permanent injury.
Disputes tend to arise over paperwork and proof. Insurers may question whether an injury is permanent, and some policies name a health insurer as the primary payer for treatment, which can change who pays first.
To make this process easier, a New Jersey car accident lawyer can review a policy's declarations page, confirm which option applies, and help organize the medical records a physician's certification may rely on.
