Commercial Truck Accidents in New Jersey
Even though truck operator negligence is the main cause of commercial truck accidents, negligence on the part of the owner of the trailer or truck, the truck operator’s employer, or the truck company itself can be found responsible for serious accidents. Cargo-loading companies and part manufacturers are also not immune to being liable for a truck accident.
Commercial truck companies are expected to hire responsible individuals and provide them with all of the skills and training that they require to drive safely on the roadway. Truck companies, as well as other entities, can be held economically accountable for your accident if you or your attorney can prove that they:
- Were negligent in the hiring, training, or supervision of their employees
- Failed to perform a background check
- Hired operators with bad driving records due to numerous traffic violations
- Failed to maintain, inspect or repair their truck or trailer
- Overloaded or improperly loaded a trailer
- Failed to replace faulty equipment or parts
There are numerous forms of financial compensation available to commercial truck accident victims that extend well beyond basic medical expenses even though these current and anticipated costs account for a major percentage of any settlement award.
In addition to medical expenses, other types of financial compensation include:
- Vehicle and property damage
- Lost income
- Diminished earning capacity
- Cost of a caregiver for those with a serious disability
- Decreased quality of life
- Loss of consortium
- Physical pain
- Emotional anguish
Commercial trucking accidents can cause more than just severe economic hardship, they can also hurt your relationship with your significant other and cause substantial psychological and emotional hurdles.
Our lawyers are prepared to gather proof of the damages you endured, like receipts and bills, along with documentation from your employer that shows your salary. We can also explain how you should document the physical, emotional, and psychological impacts of your injuries.
Although the majority of cases end up settling out of court, our team is prepared to go to trial if that’s what it takes. We are dedicated to recovering the full amount of compensation for our clients and bringing negligent drivers to account.
It is crucial to hire a lawyer who has the experience and resources to take your case to court. Insurance carriers and other people commonly involved in commercial truck accident cases do not voluntarily offer fair economic recovery to inured victims and will be even less likely to do so if you are represented by an attorney whom they know will not go to trial.
