Accidents with Serious Injuries in New Jersey
A respondent identified in a wrongful death lawsuit has to be shown to have violated the duty of care that they were supposed to show the dead in order for the claimant to be eligible for damages.
In the context of a claim for wrongful death, the standard of negligence is the course of action that a reasonable person would have followed had they been in the same or comparable circumstances. The responder will most likely be held accountable for their actions since a reasonable person would have behaved with greater care or shown more caution under similar circumstances.
For instance, if a motorist was irresponsible and broke a driving law as a result of their actions, then they have violated the obligation that they owed to the person who passed away.
