Fatal Pedestrian Accidents in New JerseyPedestrian Killed in Fatal Crash at Rte 9 & California Ave

When a loved one is tragically lost due to a fatal accident, surviving family members may be entitled to seek compensation through a wrongful death claim. In cases where negligence or another party’s actions caused the death, the family may pursue a legal claim to help cover the financial and emotional hardships they face. Here are some potential forms of compensation available in a wrongful death claim:

  • Funeral and burial expenses: Families can seek reimbursement for the costs associated with funeral services and burial, including the costs of the funeral home, transportation, and related expenses, which can be financially burdensome during an already difficult time.
  • Medical expenses incurred before death: If the deceased received medical care after the accident, their family could seek compensation for hospital bills, surgery costs, and any medical treatments that were necessary before their passing.
  • Loss of income and future earnings: In cases where the deceased was the primary income provider, their family may be entitled to compensation for the lost wages, future income, and benefits that the deceased would have contributed had they not been killed in the accident.
  • Loss of companionship and emotional distress: Family members can also seek compensation for the emotional and psychological suffering caused by the death of their loved one. This includes the loss of companionship, comfort, guidance, and care that the deceased would have provided to their family, as well as the pain and emotional trauma the survivors endure.
  • Pain and suffering before death: If the victim experienced pain, suffering, or distress before passing, the family may seek compensation for those losses.
  • Punitive damages (in cases of gross negligence): In cases of extreme negligence or intentional harm (such as DUI accidents or reckless behavior), punitive damages may be awarded in addition to compensatory damages. These are designed to punish the wrongdoer and deter similar future behavior.
