How Long Do I Have to File a Car Accident Claim in New Jersey? One Injured in Head-On Crash on Rte 21 near Rte 46

In most cases, you have two years to file a car accident claim in New Jersey. This time limit, known as the statute of limitations, usually starts on the date of the crash. Filing within this period helps preserve your ability to seek compensation for injuries and related losses.

Car accidents can lead to injuries such as whiplash, fractures, and head trauma. Some people notice pain right away, while others develop symptoms later. Medical visits soon after a crash can help identify injuries early and create records that support ongoing treatment.

New Jersey follows a no-fault insurance system for many accident claims. This means drivers often turn to their own insurance coverage first for medical expenses, regardless of fault. However, certain cases may allow a person to step outside this system and pursue additional claims, depending on the severity of injuries and policy details.

A car accident lawyer can review timelines, explain filing requirements, and help organize documents. They can also clarify how insurance rules, deadlines, and exceptions may apply to a specific situation. Understanding these factors early can make it easier to manage the process and avoid missing key deadlines.
