How Can Families File a Wrongful Death Claim in New Jersey?Pedestrian Struck and Killed in Late-Night Crash on Rte 15 MM 9

In New Jersey, a wrongful death claim allows certain family members to seek financial recovery after losing a loved one due to another party’s actions. The claim typically focuses on economic losses tied to the death, such as medical expenses, lost income, and funeral costs. State law sets specific rules on who may file and how the process works.

New Jersey law generally permits the personal representative of the estate to bring the claim on behalf of eligible survivors. These survivors often include close family members, such as a spouse, children, or parents. The claim does not address emotional losses in the same way some other legal actions might. Instead, it centers on measurable financial impacts connected to the loss.

Wrongful death cases often depend on documentation and timelines. Medical records, accident reports, and financial records can play an important role. New Jersey also applies a statute of limitations, which means claims must be filed within a set period. Missing this deadline may prevent recovery, regardless of the circumstances.

A wrongful death attorney can help families understand how New Jersey law applies to their situation. Legal guidance may assist with reviewing evidence, preparing filings, and communicating with insurers. An attorney can also explain what types of compensation may be available based on the documented losses.
