Woodbridge, NJ - Victims Hurt in Vehicle Collision on Jersey Trnpke at Newark AirportIn order for a plaintiff to be entitled to compensation in a wrongful death claim, it must be shown that the defendant neglected the duty of care that they were supposed to provide the deceased victim.

The course of action that a reasonable person would have chosen in the same or comparable circumstances is used as the standard of negligence in wrongful death lawsuits. This test is used to determine who is at fault for the death of the victim. It is probable that the person who responded would be held accountable for their actions due to the fact that a reasonable person in their position would have exercised more care or caution.

For instance, if a motorist was reckless and, as a result of their actions, broke the law, then that driver has failed to maintain the obligation that they had to the person who passed away.
