Wrongful Death Claims in New York
Establishing wrongful death in a personal injury claim differs from a criminal case. Prosecutors work to prove that a defendant is guilty beyond a reasonable doubt. Wrongful death claims are cases where the surviving family members of a deceased victim are seeking financial compensation due to the wrongful death of their loved one, who lost their life due to the negligent actions of another individual.
In order to prove liability in a wrongful death case, the claim must have certain elements, such as:
- A duty of care owed to your loved one that was breached by a negligent party. A negligent party acted in a way that neglected to consider the safety of your loved one, and, consequently, placed them in harm’s way.
There are numerous forms of negligence displayed by drivers on the road. In New York, the most common form of driver negligence seen on the road today is driver distraction. This is probably due to the widespread use of smartphones in our society. Due to their extreme popularity, people think it is ok to check their phones anytime, even when they are behind the wheel of a moving car. This behavior is never safe and should be avoided at all costs.
If you or a loved one of yours has sustained serious injuries due to the actions of a negligent driver, whether they were fatigued, distracted, speeding, or intoxicated, you may qualify for financial compensation for the damages and losses you face related to your wreck.
Even worse, you may have recently lost a loved one due to driver negligence. This is quite possibly one of the worst things that could happen to anyone. Losing a loved one can make your world seem like it has come to a complete stop. You may be wondering how you’re going to recover from the sudden loss. Although a lawyer offers little reprieve from your emotional stress, we are able to help you recover financially during this difficult time.
Unfortunately, losing a loved one in a serious auto accident usually ends up costing money in some way. Funeral care costs ranging in the tens of thousands of dollars are common. When these costs are paired with medical bills, this can be extremely stressful. If you know your loved one’s crash was caused by the negligent actions of another driver, it is vital to work with a wrongful death lawyer in New York.
