Passengers’ Legal Rights After Being Injured in a New Jersey Crash1 Killed, 2 Injured in Overnight Crash on Rte 15

In New Jersey, passengers injured in a crash have the right to seek compensation for their injuries, regardless of who caused the accident. Because passengers are generally not at fault in a collision, they are often in a strong legal position to pursue a claim.

New Jersey operates under a no-fault insurance system, which means injured passengers must first turn to their own Personal Injury Protection (PIP) or the vehicle they were riding in PIP’s coverage to cover initial medical expenses. However, when injuries meet a certain severity threshold under New Jersey law, passengers may also be able to file a claim directly against the at-fault driver.

Passengers injured in accidents on roads like Route 15, which is a heavily traveled corridor running through Sussex County, may face medical bills, lost wages, and a recovery period that extends well beyond the crash itself. Keeping records of all medical visits, treatments, and related expenses helps build a clearer picture of the full impact of the injuries. Documentation gathered early in the process can become important during insurance negotiations or legal proceedings.

When the at-fault vehicle is involved in a single-car crash, passengers may still have legal options. Claims can sometimes be filed against the driver’s auto insurance policy, and in certain cases, additional avenues may exist depending on road conditions or other contributing factors. A car accident attorney can review the available evidence and explain what compensation may be available for medical costs and other losses.
