What Should Families Do After a Fatal Motorcycle Accident in New York?Motorcyclist Killed in Car vs Motorcycle Crash on State Rte 40

After a fatal motorcycle accident in New York, families should first obtain official documents and determine who will serve as the personal representative of the estate. In most cases, only the estate’s representative can file a wrongful death claim. Securing the death certificate and requesting the official crash report are important early steps that help preserve key information.

Motorcycle accidents often result in severe harm because riders have little physical protection. When a fatal collision occurs, families may face funeral costs, loss of financial support, and other unexpected expenses.

Keep medical records, insurance letters, and any communication related to the crash organized to make the legal process more manageable. Remember that clear documentation also helps answer questions about how the incident occurred.

Under New York law, the statute of limitations for most wrongful death claims is generally two years from the date of death. If a claim is not filed within that time, a court may dismiss the case. Certain limited exceptions can apply, depending on the facts involved.

A wrongful death attorney can explain who may be eligible to recover damages and what types of compensation may be available under New York law.
