Can a Minor Riding a Scooter File a Claim in Harlem, NY?
Yes, a minor injured while riding a scooter in New York can pursue a personal injury claim, though it’s typically filed on their behalf by a parent or legal guardian.
In cases where the injury results in death, as with this crash, a parent or court-appointed representative may instead bring a wrongful death claim on behalf of the family. New York law also extends certain protections to minors that don’t apply to adults, including a longer window of time to file a claim in some circumstances.
New York City DOT data shows fatalities involving motorized two-wheelers rose roughly 120% since 2014, while injuries involving this category rose even faster, climbing about 350% since 2017. Pedestrians and motorized two-wheelers now make up a nearly equal share of all traffic fatalities citywide, at 36% and 38% respectively.
Crashes that involve scooters and larger vehicles usually result in serious injuries, such as head trauma, fractures, and internal injuries, due to the limited protection scooters offer compared to cars or SUVs.
In New York, claims that involve minors can require additional legal steps, including court approval of any settlement reached on the child’s behalf. A wrongful death lawyer can help families understand these requirements, gather evidence such as traffic camera footage, and determine whether any factor contributed to the crash.
