How Do Insurance Claims Work After a Crash in Lebanon, NJ?

After a crash, insurance claims generally begin with a police report and notification to the insurance companies involved for each vehicle. In New Jersey, drivers are required to carry personal injury protection (PIP) coverage, which can help pay for medical treatment regardless of who caused the crash.

Once a claim is filed, an insurance adjuster is commonly assigned to review the details of the crash, which includes the police report, photos, and any available witness statements. The adjuster's job is to evaluate the damage and injuries reported and determine how much the insurance company believes it owes. It's worth understanding that insurance companies are businesses, and their initial offers don't always reflect the full extent of someone's losses, especially in serious crashes that involve entrapment or extended medical treatment.

People hurt in a rollover crash may face a range of injuries, from broken bones and spinal injuries to head trauma that requires ongoing care. Medical bills can accumulate quickly, and PIP coverage often has limits that don't fully cover the cost of treatment, particularly for more serious injuries. In these situations, an injured person may need to pursue compensation beyond their own PIP coverage, which can involve filing a claim against the at-fault driver's liability insurance.

Disputes can arise at several points during the claims process. An insurance company may question whether an injury was actually caused by the crash, argue that a settlement offer is fair when it may not fully cover future medical needs, or delay processing a claim altogether. New Jersey's no-fault insurance system also adds a layer of complexity, since injured people generally must meet certain thresholds before they can step outside the no-fault system and pursue a claim against another driver.

A car accident lawyer can help victims navigate this process by reviewing insurance policies, identifying all applicable coverage, and communicating directly with adjusters on a person's behalf. Legal guidance can also help calculate the full value of a claim, such as medical expenses, lost wages, and other losses, so that any settlement reflects the true cost of what happened.
