How Long Do Crash Victims Have to File a Claim in Hackensack, NJ?
In New Jersey, the statute of limitations for a personal injury claim is generally two years from the date of the crash. If you miss that deadline, it can result in the loss of the right to seek compensation entirely, regardless of how strong the case may be.
Two years can feel like a long time, but the period after a serious crash moves quickly. Medical treatment, recovery, and the stress of everyday life can push legal considerations to the back burner. Meanwhile, evidence fades; surveillance footage gets overwritten, witness memories become less reliable, and physical evidence from the crash site disappears.
On a high-traffic corridor like Interstate 80, where the highway connects to major routes including Route 17 and the New Jersey Turnpike, reconstructing what happened depends heavily on what is preserved early.
When a vehicle may have fled the scene, the timeline for gathering information becomes even more pressing. To identify the vehicle, track down witnesses, and preserve any available footage all require prompt action. A personal injury attorney can help move through those steps efficiently while the injured person focuses on recovery.
Legal guidance can also help clarify whether any exceptions to the two-year deadline may apply. Certain circumstances such as crashes that involve uninsured or unidentified drivers, can affect the timeline and process.
