Can Passengers Seek Compensation After a Crash in Wall, NJ?
In New Jersey, passengers hurt in a traffic crash can generally file a personal injury claim regardless of which driver was at fault. Because a passenger is almost never responsible for causing a collision, they are typically well-positioned to seek compensation for their injuries. Depending on the circumstances, a claim may be filed against the driver of the vehicle they were riding in, the other driver involved, or both.
The Garden State Parkway through Monmouth County carries heavy traffic throughout the week, with volume peaking on weekends. Chain-reaction crashes, where a vehicle is pushed into a third car, can leave passengers with little warning and no ability to brace for impact.
Passengers in these crashes commonly face whiplash, neck and back injuries, and soft tissue damage that may not surface fully until days after the collision. Medical records, treatment history, and documentation gathered early in the process can be important to support a claim. It can complicate the process to delay medical attention, even when injuries seem minor at first.
A car accident attorney can help passengers understand what options may be available to them, navigate competing insurance claims, and clarify what New Jersey law allows in their specific situation. Passengers sometimes assume they have fewer options than drivers, but that is frequently not the case.
