New York Pedestrian Collisions

Upper West Side, NY - Boy Injured in Pedestrian Crash at Broadway near w 70thMore often than not, pedestrian accidents end in injuries that may be serious or even catastrophic for victims. This is most likely because pedestrians are usually traveling with no protection against fast-moving, heavy vehicles. When pedestrians are struck by cars, trucks, vans, or any other type of vehicle, they usually end up in the hospital where they must remain for weeks or longer while they attempt to physically and emotionally recover. Suffering severe injuries in a pedestrian accident is never easy, and can be totally devastating. Especially if an accident is caused by a negligent driver who was distracted, intoxicated, speeding, or fatigued. Accidents of this nature are often more severe due to the driver being preoccupied or totally inebriated while operating their vehicle.

In the United States, according to the National Highway Traffic Safety Association, over 93% of reported auto accidents happen because of negligent driving. In one recent year, over 400,000 auto accidents happened due to distracted driving alone. Drivers have become increasingly distracted, especially in the past decade. Most often, they are distracted by their smartphones or screens built into their vehicles. Looking at your phone for five seconds while traveling 55 miles per hour is equivalent to traveling the length of two football fields with your eyes closed. This is extremely dangerous and can even turn out to be deadly for anyone encountered by such a distracted driver.

With the help of a pedestrian crash lawyer, an injured pedestrian can get the financial compensation they need and deserve after being injured in a serious accident. A lawyer can help them deal with the insurance company so they’re able to successfully recover.

In New York, pedestrians legally have the right of way at crosswalks and intersections. This indicates that drivers are, by law, required to yield to them until they exit the roadway. If a collision occurs between a motorist and a pedestrian, the law also says that the motorist most likely violated their duty of care, despite whether the incident happened inside of a crosswalk.

However, pedestrians also owe certain duties of care to drivers, such as always crossing at specified crosswalks and ensuring vehicles are not headed their way when doing so.
