What Should Injured Drivers Know About Personal Injury Claims in Toms River, NJ?

In New Jersey, you generally have two years from the date of an accident to file a personal injury lawsuit against a negligent driver. This deadline makes it important to preserve medical records, insurance information, photographs, and other evidence soon after a crash.

A multi-vehicle wreck can raise questions about how responsibility should be divided among multiple drivers. New Jersey follows a comparative negligence rule. This rule allows a person whose negligence is not greater than the negligence of the person being sued to recover damages, but the amount can be reduced according to the person's share of fault.

Medical treatment is one of the most important steps after a crash because it creates a clear and official record of a person’s injuries. Emergency room visits, follow-up appointments, diagnostic tests, and physician notes all help document the extent of harm caused by the accident and connect those injuries directly to the collision.

Without prompt medical care, it can become more difficult to prove the seriousness of an injury or show that it resulted from the crash rather than another cause, which may affect an insurance claim or legal recovery.

A car accident lawyer can play a key role in these situations by helping injured victims protect their rights and build a strong case. An attorney can assist in gathering medical records, working with insurance companies, and collecting other evidence needed to establish liability and damages. T
